I am interested in bidding at a mortgage foreclosure sale that is being auctioned by the Clerks office. What do I need to do? It is suggested that you come in person to the Clerk's office on the day of the sale and register with the Clerk. Florida Statutes 45 require that a bidder other than the judgment holder must present a good faith deposit of 5% of your projected bid in cash or cashiers check in order to confirm a bid. You may contact the civil division for a written policy regarding foreclosure sales.
How can I find a list of the property being auctioned by the clerk? You can access a date listing of all sales to be held by the Clerk from the Clerk's website under Foreclosure Sales. If you do not have access to the Internet, a printout of these listings are available at the Clerk of Courts office in our Civil department. The final judgment of foreclosure will set the sale date, state the legal description of the property to be sold and the amount of the unpaid judgment.
