AUTHORITY:
The processing of court cases is governed by Florida Statutes, Florida Rules of Court, Administrative Orders and local rules. Florida Rules of Court, published annually detailing rules of the State of Florida Supreme Court, provides relevant data for each specialized area of the law. In addition to the governance for procedure, it includes specific forms necessary in the practice of law. It would be helpful for you to read and be familiar with the Rules of Court applicable to your area of the law.

ON-LINE ACCESS:
Access to certain circuit and criminal case information is available via www.manateeclerk.org from your office or home.

CASE INQUIRIES:
1) Have case number handy when calling the Clerk's Office about a specific case;

2) Cite case number in correspondence with the Clerk's Office;

3) To expedite return of copies, please furnish self-addressed stamped envelope (SASE).

FILINGS:
New cases and associated pleadings may be filed by mail or delivered to the appropriate department on the second floor of the Courthouse. Each department has its own "in-basket" where documents/pleadings are to be left for filing. If mailing, designate the appropriate department i.e., "Circuit Civil", "Juvenile", "Traffic" in the address line on all mail. Include self-addressed stamped envelope (SASE) with postage for return of copies to you.

Please note that if filing in person for a case set for Court within the following 48 hours, you should ask the clerk to hand clock, docket and deliver it to the assigned judge as soon as possible so that it may be filed in time for Court.

Filing by FAX is not allowed by law.

PAPER REQUIREMENTS:

All Court papers should be filed on recycled paper measuring 8 1/2 x 11 inches. Please note following Rule.

Florida Rules of Judicial Administration
RULE 2.055 PAPER

(a) All pleadings, motions, petitions, briefs, notices, orders, judgments, decrees, opinions, and other papers and official documents filed in any court shall be filed on recycled paper measuring 8 1/2 x 11 inches. For purposes of this rule, paper is recycled if it contains a minimum content of 50 percent waste paper. Xerographic reduction of legal-size (8 1/2 x 14 inches) documents to letter size (8 1/2 x 11 inches) is prohibited.

(b) Any exhibit or attachment filed with pleadings or papers may be filed in its original size.

(c) A 1 1/2 inch square (1 1/2 by 1 1/2 inches) in the upper right-hand corner of all papers filed shall be left blank for use by the clerk of court.

For documents to be recorded, according to Florida Statute 695.26:

(e) A 3-inch square at the top right-hand corner on the first page and a 1 inch by 3 inch space at the top right-hand corner on each subsequent page is reserved for use by the clerk of the court.

SERVICE CHARGES:
Filing fees, service charges and additional assessments are authorized by Florida Statutes, Administrative Orders and Board of County Commission Ordinances.

TIME:
Florida Rules of Judicial Administration

RULE 1.090 TIME

(A) Computation. In computing any period of time prescribed or allowed by these rules, by order of court, or by any applicable statute, the day of the act, event, or default from which the designated period of time begins to run shall not be included. The last day of the period so computed shall be included unless it is a Saturday, Sunday, or legal holiday, in which event the period shall run until the end of the next day which is neither a Saturday, Sunday, or legal holiday. When the period of time prescribed or allowed is less than 7 days, intermediate Saturdays, Sundays, and legal holidays shall be excluded in the computation.

AMERICANS WITH DISABILITIES ACT:
Specific language is required on all communications noticing court proceedings, including but not limited to subpoenas, summonses and notices regarding reasonable accommodations for persons with disabilities. See language below.

In accordance with Administrative Order No. 95-01, language on Americans with Disabilities (ADA) accommodations, follows:

Examples of documents requiring ADA language include but are not limited to subpoenas, summonses and notices.

RULE 2.072 POSSESSION OF COURT RECORDS

No person other than judges and authorized court employees shall remove court records as defined in rule 2.075 from the clerk's office except by order of the chief judge or chief justice upon a showing of good cause.
